Restricting Freedom of Peaceful Assembly During Public Health Emergencies

As the second wave of COVID-19 pandemic in Canada continues, so too does litigation challenging policies intended to slow spread virus. A growing number claimants have argued that these sweeping public health measures — many them drastic and previously unimaginable infringe various provisions Canadian Charter Rights Freedoms.1 While a significant claims been brought pursuant protections support sustained body jurisprudence, litigants may yet seek explore some more forgotten sections Charter, particularly section 2(c)’s guarantee freedom peaceful assembly. In an effort encourage development jurisprudence on 2(c), this article envisions how such challenges might unfold.
